A legal study of the medical oversight request by emergency medical service provider for withholding resuscitation following the guardian¡¯s refusal

Abstract
Korean emergency medical service (EMS) is carried out under the medical oversight of emergency physician medical director. Among the medical oversight, the withhold of resuscitation in prehospital stage is an item that requires direct medical oversight Guideline for cessation of resuscitation (withhold and withdraw) include the two principle of medical futileness and respect for patient¡¯s autonomy. If resuscitation does not recovery patient¡¯s cardiac function, and it is clear that the patient did not wish resuscitation, withhold resuscitation can be justified. However, among the current standard guidelines for on scene EMS for EMS providers, there is a guideline for requesting medical oversight when the guardian request withhold resuscitation. It is common for a guardian to make a decision on behalf of the patient in Korea. However, in patients with cardiac arrest, the request for withhold resuscitation by guardinan is not the case for principle of medical futileness and respect for autonomy. In this study, it will be examined whether the medical oversight request for withhold resuscitation by EMS provider is appropriate, according to the principles of resuscitation cessation and legal aspects and to discuss institutional supplements by examining abroad cases.
